Refund policy

Cancellation; Refunds; Installation; Delivery:

Customer may cancel an order with East Coast Hardware (“ECH”) within Three (3) days of the date of the first payment and receive a full refund. In the event that Customer would like to cancel the installation of an order, Customer shall provide ECH with written notice at least Ten (10) days prior to the installation date and Customer shall pay ECH a cancellation fee equal to Five Percent (5%) of the balance due. If Customer provides ECH with less than Ten (10) days’ written notice prior to the installation date of Customer’s intent to cancel the installation, Customer shall pay ECH a cancellation fee equal to Fifty Percent (50%) of the balance due. If Customer cancels once ECH arrives to perform the installation, Customer shall pay a cancellation fee equal to the entire balance due. For any cancelled orders for which the product has been delivered to ECH, Customer shall have Seven (7) days after ECH has notified customer of receipt of the product to either pick up the product from ECH or schedule a delivery date with ECH. If Customer does not pick up the product within the Seven (7) day period, the products will be deemed abandoned by Customer and ECH may dispose of the products as determined by ECH in its sole and absolute discretion and Customer hereby waives any and all claims against ECH. ECH reserves the right to charge a delivery fee in addition to the delivery fee set forth on the Estimate, if any, in its sole and absolute discretion. Any delivery fee shall be immediately due and payable by Customer to ECH. ECH will schedule installation once it receives the product subject to ECH's availability. Outdoor installations cannot be completed when the ground is frozen and/or wet or any inclement weather is predicted for the installation date. Installations may be re-scheduled by ECH at any time in its sole discretion. Customer is responsible for ensuring that no sanding and/or construction is done at the location of the installation site within Thirty Six (36) hours prior to installation. In the event that ECH arrives to perform the installation and ECH determines, in its sole discretion, that sanding and/or any type of construction was performed or ECH cannot perform the installation due to the condition of the installation site, Customer shall pay ECH a re-scheduling fee of Ten (10%) of the balance due. Customer authorizes FHHT to debt any credit card provided by Customer to ECH for any outstanding balance due to ECH as determined by ECH in its sole discretion.

Warranty; Disclaimer; Limitation of Liability:

Customer agrees that no representation, expressed or implied, and no warranty or guaranty is provided by ECH with respect to the products. ECH makes no representations, expressed or implied, and no warranty or guaranty regarding any products. ECH does not endorse or warrant, and is not responsible for, the reliability and/or functioning of any products. Customer agrees and acknowledges that any and all warranties for the products supplied by ECH is through the manufacturer. ECH provides a Ninety (90) day warranty for the installation services provided by ECH provided that the product including any cables have not been interfered with by Customer or any third party as determined by ECH in its sole and absolute discretion. In the event that ECH determines that a service call is not covered by ECH's warranty, Customer agrees to pay ECH a service fee in an amount determined by ECH which shall be due and payable immediately. In no event shall ECH be liable for any special, incidental, indirect, or consequential damages related to the products or installation services. In the event that Customer experiences any defects with products, ECH and any of its officers, owners, employees, agents, successors, and/or assigns shall not be responsible or liable for any loss or damage caused by Customer’s reliance on or use of any product whether based in contract, tort, strict liability, or otherwise and regardless of the legal or equitable theory pled, including without limitation any damages that result from any mistake, omission, virus, delay, or interruption in operation or service or any failure of performance.

Miscellaneous:

In the event that any party hereto is required to engage the services of legal counsel to enforce its rights against any other party hereto, regardless of whether such action results in litigation, the prevailing party shall be entitled to collect and recover reasonable attorneys’ fees and costs from such other party, which in the event of litigation shall include fees and costs incurred both at trial and on appeal. No portion of the Estimate and Terms and Conditions shall be construed against any drafting party. The parties agree that the Estimate and Terms and Conditions shall be construed and enforced in accordance with Rhode Island law. In any litigation connected with the Estimate and/or Terms and Conditions, Customer irrevocably consents to and confers exclusive jurisdiction on the courts of the State of Rhode Island and on the United States District Court for the District of Rhode Island, and hereby expressly waives any objections to venue in any such courts. There are no verbal understandings changing or modifying any of the terms hereunder. The Estimate and Terms and Conditions supersede all prior negotiations and agreements and is the entire understanding between the parties. There are no representations or warrantees other than those expressly described herein. All of the terms and provisions shall be binding upon and inure to the benefit of and be enforceable by the successors, assigns, heirs, executors or administrators of ECH and Customer. All of the parts and provisions set forth herein are severable and separable, and in the event that they, or any one of them, shall be deemed to be void, invalid, or unenforceable by a court of competent jurisdiction, then the Estimate and Terms and Conditions shall be interpreted as if such void, invalid, or unenforceable parts or provisions were not set forth herein, and the remaining parts and provisions hereof shall remain enforceable to the extent permitted by applicable law.
